Cookies and Personal Information for our users logging in to The Service

We may use cookies to help enhance your use of the Service, recognise you on any return visits you make to the Demographix website and to make other procedures easier for you. Cookies are small pieces of information, which will be stored by your browser on your computer's hard drive. The cookies used by Demographix will not give Demographix any personal details about you. For Users of the Service, Demographix's use of cookies includes but is not limited to:

• To give you access to parts of the site that require you to be logged in
• To remember open/collapsed pages on navigator and analysis pages

Acceptance of terms

By using the services of Demographix Limited and using your user ID and password you are agreeing to these Terms of Use. If you do not now or at any time in the future agree to these Terms of Use you should not use your account.

User conduct

You agree not to use the Demographix services for any illegal purpose or to promote violence or race hatred or discrimination.

Copyright

The content, design and operation of the Demographix services and all intellectual rights are protected by the law of copyright.
Users of the services of Demographix Limited warrant that no materials they enter or upload into the system infringe the rights of third parties.

Disclaimer of warranties

The services provided by Demographix Limited are provided "as is" and "as available" and Demographix Limited makes no express or implied warranty as to the functionality accuracy or reliability of the services it provides nor does it guarantee that the service in part or in its entirety will be available at a particular time or from a particular location. Use of the services of Demographix Limited is at your own risk. Because some jurisdictions do not permit the exclusion of certain warranties, these exclusions may not apply to you.

Limitation of liability

Demographix Limited will not be liable for any direct, indirect, punitive, incidental, special, or consequential damages that result from the use of, or inability to use its services.

International use

Demographix Limited makes no representation that the materials, services or information it provides are appropriate or available for use in locations outside the United Kingdom and accessing them from territories where their use is illegal is prohibited. Those who choose to use the materials, services or information provided by Demographix Limited from other locations do so on their own initiative and are responsible for compliance with local laws.

Choice of law and scope

These Terms of Use shall be construed and performed in all respects in accordance with and shall be governed by the laws of England and Wales and we irrevocably submit to the exclusive jurisdiction of the English courts.
This agreement shall constitute the entire agreement between yourself and Demographix Limited.

Termination

Demographix Limited reserves the right to terminate your account and access to its services and data by all users belonging to your account with or without notice. You may terminate this agreement by giving 90 days notice. You will be responsible for retrieving all your data from the Demographix web site before the end of this notice period. At its sole discretion Demographix Limited may refund the unused part of your subscription.

User accounts and security

The first person registering a user ID and password for an account will be termed the "Account holder".
The account holder and other users will each have their own user ID and password.
Demographix Limited may provide facilities to allow the account holder and other users to add additional users to an account. When a user is added a reference to these Terms of Use will be emailed to them. All users must keep their user ID and password confidential. Demographix Limited will not be responsible for the consequences of any user IDs or passwords being revealed to third parties by whatever means
Users are required to ensure that they exit from their account at the end of each session.
If any user believes that a user ID or password has been revealed to third parties they must inform Demographix Limited immediately.
The account holder may be liable for losses incurred by Demographix Limited or any other party occasioned by the unauthorised use of their account.
Demographix Limited will put in place reasonable measures to prevent loss corruption or unauthorised access to an account's data but will not be liable for the consequences of any such loss corruption or unauthorised access.

Limits

Demographix Limited may establish limits on the amount of data stored in its system. Demographix Limited will make reasonable efforts to notify the account holder if such limits are or are likely to be exceeded.

Charges

Details of the charging schemes for using the services provided by Demographix Limited are available on its web site. Demographix will give a minimum of 30 days notice of changes in these charges.
All charges become due for payment on receipt of invoice. In the event of charges not being paid Demographix Limited reserves the right to limit or terminate access to an account's facilities and data by all users of that account.
The account holder must inform Demographix Limited of any changes to their billing details. They must inform Demographix Limited if they wish to change the account holder.
All charges will be subject to taxes applicable in the United Kingdom or location of the account holder or both.

Changes to this agreement

Notification of changes to these terms, charges, facilities or any other aspect of the services provided by Demographix Limited may be delivered by email to the account holder or by regular mail or within the services themselves. Demographix Limited has no obligation to inform additional users of any changes in any aspect of the service.

Usage rights

You agree not to reproduce, duplicate, copy, sell, or resell any portion of the Service, use of the Service, or access to the Service unless authorised in writing by Demographix Limited.

Exclusivity

You understand that Demographix Limited will provide this service on a non-exclusive basis.

Confidentiality

Demographix Limited will take all reasonable measures to protect the confidentiality of information stored or generated by Demographix' services and to prevent it being revealed to unauthorised parties but will not be liable for any breach of confidentiality how so ever caused.

Demographix Limited and its agents will have access to data entered into or generated by its services. Such access and the information gathered will not be used except for the maintenance and development of Demographix and its services.

Trial account

A trial account is made available for the purposes of evaluating the Demographix service and facilities. No commercial use may be made of a Demographix trial account or the information it generates.
